General Terms and Conditions of holiday homes Bellavita

 

1. General:

For all accommodation contracts concluded between you and us, individual agreements apply first and foremost, followed by the following general terms and conditions. All contractual agreements must be in writing to be valid, e.g. in electronic form (§ 126a BGB) oder in Textform (§ 126b BGB).

 

2. Conclusion of the contract:

Once we have received your booking, which is binding for you for 3 days, you will receive a booking confirmation from us within 4 days at the latest. Please note that the accommodation contract is only concluded upon receipt of our booking confirmation.

We process your booking requests on working days between 9:00 a.m. and 6:00 p.m.

 

3. Subject matter of the contract:

By concluding the contract, you rent one of our beautiful holiday apartments in your holiday home “Bellavita”, Am Pfaffensee 19, 67376 Harthausen, for the period stated in the booking confirmation and for the agreed number of people. Of course, the inventory included in our holiday apartments is available to you for the agreed rental period.

 

4. Number of people:

Please note that the holiday apartment may only be occupied by the number of people stated in the booking confirmation.

 

5. Pets:

We ask for your understanding that animals are only allowed with our express written permission.

 

6. Prices and payment methods:

The prices valid at the time of contract conclusion can be found in the price list on the website of vacation homes Bellavita (www.fewo-bellavita.de).

Later price changes are irrelevant for you.

Please pay the rental price shown in the booking confirmation on site when you receive the keys.

 

7. Services:

The holiday apartments “Am Pfaffensee” offer you the following services included in the accommodation contract:

    • Use of the holiday apartment you have booked, including garden
    • Use of the inventory included in the holiday apartment
    • A normal final cleaning of the holiday apartment at the end of your stay
    • Bed linen and towels (for stays of more than two weeks, bed linen change/intermediate cleaning of the holiday apartment)
    • Costs for electricity, water, garbage collection and public expenses
    • Bicycle storage
    • Travel cot/high chair
    • The stay is also free for our little guests from 0 to 5 years.
    • A washing machine and dryer are available for a small fee.

 

8. Early departure and cancellation by our guests:

If you withdraw from the contract concluded with us, the following rental prices are still due:

  • Up to 20 days before the start of the rental period: 0% of the agreed rent

  • Between 19 days and 10 days before the start of the rental period: 50% of the agreed rent

  • From the 9th day before the start of the rental period: 90% of the agreed rent

Please note that in case of early departure you are not entitled to a refund of the pro rata rent

 9. Cancellation by the owner of the holiday homes Bellavita:

We are entitled to terminate the contractual relationship concluded with you without notice if, despite repeated requests to pay the agreed rent, you do not pay it before the start of the rental period or if you behave in such a way that is contrary to the contract that we cannot reasonably be expected to continue the contractual relationship.

In such a case, we are entitled to demand compensation for the expenses incurred up to the time of termination and for lost profits.

 10. Arrival and departure:

When you arrive, you can usually take over or move into your desired holiday apartment between 4:00 p.m. and 8:00 p.m. Exceptions are possible by arrangement.

Please understand that we may reassign the holiday apartment you have booked if you do not arrive at the agreed time.

We ask that you hand over the holiday apartment to us properly by 10:00 a.m. on your day of departure.

Please note that if you do not leave the holiday apartment by the agreed time and have not checked out with us or returned the key, you will still have to pay the agreed rent for the following day, even if you leave on the same day.

 11. Duties of our guests:

  • Please ensure that you and your fellow travelers treat our holiday apartment with the greatest possible care and return it to us in perfect condition, as you found it.

  • To ensure a smooth stay, we rely on you to report any complaints to us immediately, within 12 hours, and to check that the inventory list displayed in the holiday apartment is complete, so that we have the opportunity to remedy the defects within a reasonable period of time.

Please understand that later complaints can no longer be accepted.

  • If you or your fellow travelers cause damage and/or destruction, you must also inform us immediately. You and your fellow travelers are jointly and severally liable for any damage caused by you or your fellow travelers.

  • For the sake of completeness, we would simply ask you to note that all items of any kind located in the holiday home us are the property of your holiday homes Bellavita. Any infringement of our property rights will be asserted in the ordinary courts. In addition, proven thefts will be reported immediately.

At this point we would like to refer you to our house rules contained in the information folder, which are also part of this agreement and are a basic requirement for a relaxing stay in the Bellavita holiday apartments. The mutual consideration requirement includes, among other things, avoiding disturbing noises, in particular loud slamming of doors and activities that annoy your neighbors with the noise they create and disturb the peace and quiet of the home or endanger the reputation of the Bellavita holiday apartments.

Therefore, in all your activities, please observe the night-time quiet hours from 10 p.m. to 8 a.m., which also apply in Harthausen, as well as the midday quiet hours from 1 p.m. to 3 p.m.

Finally, we would like to point out that smoking is only permitted outside and in the garden.

 

12. Disclaimer:

We are liable for our obligations arising from the contract concluded with you. Customer claims for damages are excluded. Excluded from this are damages resulting from injury to life, body or health if we are responsible for the breach of duty, other damages based on an intentional or grossly negligent breach of duty by the holiday apartments and damages based on an intentional or negligent breach of contractual obligations. A breach of duty by a legal representative or vicarious agent is equivalent to a breach of duty by the Bella Vita holiday apartments.

Furthermore, we are not liable for service disruptions in connection with services that are merely brokered as third-party services and that are expressly identified as third-party services. Furthermore, we are not liable in cases of force majeure.

Otherwise, the statutory provisions apply.

 

13. Internet usage:

The Bellavita holiday apartments provide you with free Internet access via WLAN/WiFi.
This provision of Internet access is a voluntary service that consists solely of providing an encrypted WLAN signal. You must meet the technical requirements for receiving the signal. We will be happy to provide you with your access data, which may not be passed on in your own interest. We reserve the right to restrict access in the event of long-term use or blocking.
Please note that the provision of Internet access is not part of the accommodation contract. We cannot guarantee the constant availability of Internet access, as the permanent availability of the Internet connection is not within our sphere of influence. A failure of access or the absence of a WLAN signal does not constitute a defect in the rental property and does not entitle you to a reduction in the rent or to extraordinary termination of the accommodation contract. Liability claims or compensation for possible failures are therefore excluded.

We would like to point out that you are obliged to comply with the legal provisions when using the Internet access and that any misuse will result in the immediate disconnection of access. Claims for damages due to possible legal consequences for us as the connection owner remain unaffected. If Internet access is made available, it may only be used for information purposes. It is strictly forbidden to download illegal files, images, music, films, etc.

In the case of warnings, the following applies: the address of the guest will be communicated to the applicant under the condition that only the guest is liable for all claims of the applicant.

14. Final provision:

Should a provision of this contract be invalid or unenforceable or become invalid or unenforceable in the future, the remaining provisions of this contract shall not be affected.

Place of performance and payment is Speyer.

German law applies. The application of the UN Convention on Contracts for the International Sale of Goods and the conflict of laws is excluded
